1. Statement of independence
SUNRISE MARINE AUSTRALIA PTY LTD (ABN 61 697 392 706, ACN 697 392 706), trading as Sunrise Marine Australia, is an independent supplier of surplus industrial equipment, drawing on the founder's 30+ years of global industry experience in surplus, unused, and end-of-project industrial spares. We are not an authorised distributor, agent, partner, representative, dealer, reseller, or affiliate of any original equipment manufacturer ("OEM") referenced on this website, in our correspondence, or in our catalogue, unless we explicitly state otherwise in writing in the listing for a specific item.
All product names, brand names, manufacturer names, model numbers, part numbers, logos, trade dress, marketing imagery, and trademarks (whether registered or unregistered) shown anywhere on this website remain the exclusive property of their respective owners. Our use is for identification only.
2. Nominative fair use
We rely on the legal doctrine of nominative fair use (and equivalent doctrines under Australian, US, EU and other applicable trademark law) to identify, by name and model number, the OEM-branded surplus equipment we offer for resale. Our use of OEM names and models is:
- Necessary — a buyer of a Rosemount 3144P transmitter needs to know they are being offered exactly that part; using a generic description would be misleading;
- Limited — we use only as much of the OEM mark as is reasonably required to identify the item (the brand name, the model and part number);
- Non-suggestive — nothing in our use suggests sponsorship, endorsement, partnership, or affiliation with the OEM.
3. No authorised-distributor representation
We do not represent that we are an authorised distributor of any of the brands referenced on this site. If you require purchase through an authorised distribution channel — for example, to preserve a manufacturer warranty, satisfy an end-user procurement policy, or meet a specific tendering requirement — you should not purchase from us. Instead, contact the OEM directly to identify an authorised channel.
Where we have entered into a written distribution or supply agreement with a particular OEM, that arrangement will be explicitly disclosed in the relevant product listing.
4. No OEM warranty implied
Manufacturer warranty does not transfer with surplus equipment, regardless of condition grade. We offer only our own honest condition-statement and a limited warranty as set out in our Terms of Sale. No reference on this site to an OEM brand or model implies any extension or assignment of the OEM's warranty to a buyer of surplus from us.
5. Brands referenced on this site
Our catalogue references a number of OEM brands solely to identify the items we have in stock. The following non-exhaustive list of brands and trademark owners is provided for the avoidance of doubt. All such marks belong to their respective owners:
Inclusion of a brand in this list — or any reference to a brand elsewhere on the site — does not indicate authorisation, endorsement, sponsorship, or any other commercial relationship with the trademark owner. The list is illustrative and may be updated as our catalogue changes.
6. Use of photographs & images
6.1 Product photographs. All product photographs on this website show the actual stocked item, photographed by us at our facility, unless explicitly labelled as a "representative image". We do not present OEM marketing photography as if it were our own stock photography.
6.2 OEM nameplate close-ups. Photographs frequently show OEM nameplates, serial numbers, and part-number labels — necessary for the buyer to verify they are receiving the exact part. This use is incidental to the sale of the genuine item and falls within nominative fair use.
6.3 Hero and category photography. Hero images on category and information pages are general industrial photography, licensed appropriately from stock libraries, and are not represented as photographs of items in our stock.
6.4 Watermarking. We may lightly watermark product photographs to deter unauthorised scraping by third parties. This does not alter the identification of the OEM item.
7. Anti-counterfeit policy
Sunrise Marine operates a strict zero-tolerance policy on counterfeit, grey-market, relabelled, or trademark-infringing equipment:
- We do not buy equipment without traceable provenance or where authenticity is in doubt;
- We do not sell aftermarket, "compatible", or unbranded items as OEM. If we list an OEM brand, we mean a genuine OEM-manufactured item;
- We do not modify nameplates, serial numbers, labels, or markings on any item;
- We do not refurbish-and-relabel equipment as new;
- We co-operate with OEM brand-protection teams and Australian authorities in any legitimate enforcement action.
Where there is any reasonable doubt about authenticity, the item is either withdrawn from sale, sold explicitly as "For Parts" with full disclosure, or destroyed.
8. Provenance & traceability
Every item entering our catalogue is qualified for source, technical condition, and commercial viability. We work directly with industrial closures, fleet modernisation programs, facility decommissioning teams, insolvency administrators, and engineering contractors with project-end surplus. We do not deal in:
- Stolen goods, or items where ownership cannot be traced;
- Equipment sourced from sanctioned jurisdictions or sanctioned parties;
- Items marketed under one brand but manufactured by another (private-label rebadging) without explicit disclosure;
- Items whose nameplates have been altered, removed, or replaced.
9. Certifications & documentation
Where an item is supplied with original OEM certificates — for example, calibration certificates, Declarations of Conformity, ATEX/IECEx certificates of conformity, type-test reports, or Material Test Reports — we supply genuine copies as received. We do not create, alter, or fabricate certification documents. Buyers requiring re-certification should arrange this through the OEM or an accredited testing house at their own cost.
10. Notice & takedown procedure
If you are a trademark owner (or an authorised agent acting on behalf of one) and believe that content on this website infringes a trademark you own — for example, an improper use of a logo, a misleading representation of authorisation, or use of OEM marketing imagery without authorisation — please contact us using the details below.
A notice should include:
- Your contact details and the trademark owner you represent;
- The trademark allegedly infringed (jurisdiction, registration number where applicable);
- The specific URL(s) on our site containing the allegedly infringing content;
- A clear description of the alleged infringement;
- A statement of good-faith belief that the use is not authorised by the owner or law;
- A signature (electronic acceptable) and contact details for follow-up.
We will acknowledge receipt within two (2) Business Days and respond substantively within ten (10) Business Days. Where we agree the content is infringing or are uncertain, we will remove or modify the content while we investigate. We may also, where appropriate, share a copy of the notice with the original supplier or original photographer.
